Terms of Service

1. Acceptance of Terms

By accessing or using Unbrowse AI ("the Service"), including our website, browser extension, and related services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Unbrowse provides an AI-powered browsing automation platform that:

  • Captures and stores network traffic from your browsing sessions
  • Enables AI agents to perform automated tasks on your behalf
  • Stores encrypted authentication credentials
  • Provides an AI chat interface for task automation
  • Allows users to contribute browsing patterns to a shared index

3. User Accounts and Registration

3.1 Account Creation

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information
  • Maintain the security of your password
  • Be responsible for all activities under your account
  • Notify us immediately of any unauthorized use

3.2 Age Requirements

You must be at least 13 years old to use the Service. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

4. Acceptable Use Policy

You agree NOT to use the Service to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights

  • Network traffic and metadata are stored unencrypted for functionality
  • You are responsible for managing what sites you record

6. Intellectual Property Rights

6.1 Unbrowse's Rights

The Service and its original content, features, and functionality are owned by Unbrowse and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 Your Content

By using the Service, you grant Unbrowse a worldwide, non-exclusive, royalty-free license to:

  • Store and process your browsing data
  • Use anonymized data to improve the Service
  • Share browsing patterns (without credentials) with other users via the ability index
  • Train and improve AI models

7. Billing and Payments

7.1 Paid Services

Certain aspects of the Service may be provided for a fee. You agree to pay all fees associated with your use of paid services.

7.2 Revenue Sharing

If you contribute browsing abilities that are used by AI agents, you may be eligible for revenue sharing according to our published rates. We reserve the right to modify revenue sharing rates with reasonable notice.

7.3 Refunds

Fees are non-refundable except as required by law or as expressly stated otherwise.

8. Third-Party Services

The Service may integrate with or access third-party services and websites. You acknowledge that:

  • You are responsible for complying with third-party terms of service
  • Unbrowse is not responsible for third-party services or content
  • Automating access to third-party services may violate their terms
  • You use third-party integrations at your own risk

9. Disclaimer of Warranties

Important Legal Notice

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

Unbrowse disclaims all warranties, including but not limited to:

  • Warranties of merchantability or fitness for a particular purpose
  • Non-infringement of third-party rights
  • Uninterrupted or error-free service
  • Accuracy, reliability, or completeness of content
  • Security of data transmission or storage

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNBROWSE SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or use
  • Damages resulting from unauthorized access to your account or data
  • Damages resulting from third-party services or websites
  • Damages resulting from Service interruptions or errors

Our total liability shall not exceed the amount you paid to Unbrowse in the 12 months preceding the claim, or $100, whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless Unbrowse, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of third-party rights
  • Your violation of applicable laws

12. Termination

12.1 Termination by You

You may terminate your account at any time by contacting us at support@unbrowse.ai

12.2 Termination by Unbrowse

We may suspend or terminate your access to the Service immediately, without notice, for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Harm to other users or the Service
  • Non-payment of fees
  • Extended inactivity

12.3 Effect of Termination

Upon termination:

  • Your right to use the Service immediately ceases
  • We may delete your account and data
  • You remain liable for any outstanding fees
  • Provisions that should survive termination will continue to apply

13. Dispute Resolution

13.1 Informal Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting legal@unbrowse.ai

13.2 Arbitration

If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except as modified by these Terms.

13.3 Class Action Waiver

You agree that disputes will be resolved on an individual basis and not as part of a class action, consolidated action, or representative action.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting the new Terms on this page
  • Updating the "Last Updated" date
  • Sending a notification via email or the Service

Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

16. Miscellaneous

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Unbrowse.

16.2 Severability

If any provision of these Terms is held to be unenforceable, the remaining provisions will remain in full force and effect.

16.3 Waiver

No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.

16.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
